2025 will see the entry into force of the registry of short-term rentals and the creation of the Digital Window for rentals. The measure responds to European regulation and seeks to create a system for collecting and exchanging this type of rental.
What is the registry of short-term rentals
Although it is already in force, the first aspect to bear in mind is that the Registry of Leases will not be effective until July to offer a period of adaptation.
This single registry of short-term rentals is a measure that requires properties for holiday and temporary use to have an identification number. There are two fundamental issues:
• Only short-term rental services advertised online will need identification and register.
• Platforms will have to display this registration number in their advertisements. Those that do not include it must get removed.
The goal is to control non-permanent rental services and prevent fraud and scams.
Function of the Digital Single Window
This service is now operational alongside the single registry of short-term rentals. Platforms that advertise tourist rentals online must provide data on the accommodation. The digital window for rentals will act as a link to exchange information between platforms and the Administration.
Doubts about the Register of short-term rentals
The entry into force of the registry has generated many doubts among temporary rental owners:
What is meant by short-term rental
In this regard, it is worth taking into account a few points:
- A short-term rental is made for a short period and a fee.
- The accommodation must be different from the usual residence (study, work, holiday, etc.).
- It applies to whole properties and parts of them, such as rooms, and includes boats.
How to obtain the registration number
To do so, you must submit the corresponding application through the electronic office of the College of Registrars. It needs the following information:
- Owner's details.
- Type of accommodation and number of people who can stay there.
- Address, unique cadastral code and cadastral reference (boat identification number or registration number, in the case of vessels).
Obligations of landlords and online platforms
Landlords are obliged to provide the required information to the registry, update it when necessary and communicate the registration number to the online platforms on which they publish their properties.
The platforms, for their part, must ensure that landlords include the identification number in their advertisements and, to do so, they must offer facilities. In addition, they must report monthly to the Digital Window for rentals data on the activity of each unit advertised on them. And, if the authorities order the withdrawal of an advertisement, they must do so within 48 hours.
Penalties
Failing to comply with the requirements of the single registry of short-term rentals will lead to penalties. For the time being, and in the absence of a specific penalty regime, the requirements of the state, regional and local regulations will apply.
